Acceptable Use Policy

Summary: Use our services lawfully and responsibly. Any activity that harms others, violates the law, or damages our infrastructure is strictly prohibited and may result in immediate account termination without refund.

1. Overview

This Acceptable Use Policy ("AUP") governs your use of all services provided by Nexlara LLC ("Nexlara"). This policy is incorporated into and forms part of our Terms of Service. By using any Nexlara service, you agree to comply with this AUP.

2. Prohibited Content

You may not use Nexlara services to host, transmit, store, or distribute any content that:

  • Is illegal under applicable laws in the USA, UK, or the jurisdiction of the end user
  • Constitutes child sexual abuse material (CSAM) or any material that exploits minors
  • Promotes or facilitates violence, terrorism, or hate crimes
  • Is defamatory, fraudulent, or misleading
  • Infringes any copyright, trademark, patent, or other intellectual property right
  • Contains malware, spyware, ransomware, trojans, or other malicious code
  • Is designed to facilitate phishing, identity theft, or social engineering attacks
  • Violates any individual's privacy, including doxxing or non-consensual intimate imagery

3. Prohibited Activities

You may not use Nexlara services to conduct or facilitate:

  • Sending unsolicited bulk email (spam) or operating open mail relays
  • Denial-of-service (DoS or DDoS) attacks against any target
  • Port scanning, vulnerability scanning, or unauthorised access attempts on third-party systems
  • Cryptocurrency mining without prior written approval from Nexlara
  • Operating botnets, command-and-control servers, or similar infrastructure
  • Reselling our services without prior written agreement
  • Any activity that causes excessive resource consumption or degrades service for other customers
  • Circumventing any technical measures implemented by Nexlara

4. Resource Usage

Shared hosting accounts are subject to fair use resource limits. You must not consume excessive CPU, memory, or bandwidth in a manner that negatively impacts other customers on the same server. VPS accounts have defined resource allocations as specified in your plan. Nexlara reserves the right to throttle or suspend accounts that consistently exceed fair use thresholds.

5. Email Usage

Email services provided by Nexlara must not be used to send spam, phishing emails, or unsolicited commercial messages. You are responsible for maintaining proper email authentication records (SPF, DKIM, DMARC) on your domains. Accounts generating excessive bounce rates or spam complaints may be suspended.

6. Enforcement

Nexlara reserves the right to investigate any suspected violation of this AUP. If we determine, in our sole discretion, that a violation has occurred, we may take any of the following actions: issue a warning, suspend your account temporarily, terminate your account permanently without refund, or report the activity to law enforcement authorities.

We cooperate fully with law enforcement agencies and will disclose customer information when required by valid legal process.

7. Reporting Abuse

If you become aware of any violation of this AUP involving Nexlara services, please report it to [email protected]. We take all abuse reports seriously and will investigate promptly.

8. Changes to This Policy

We may update this AUP at any time. Continued use of our services following any changes constitutes acceptance of the revised policy.
