1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Nexlara LLC, a limited liability company registered in the State of Wyoming, USA ("Nexlara", "we", "us"). By accessing our website at nexlara.com or purchasing any of our services, you agree to be bound by these Terms in full.

If you do not agree to these Terms, you must not use our services. We reserve the right to modify these Terms at any time. Continued use of our services following any changes constitutes your acceptance of the revised Terms.

2. Services

Nexlara provides web hosting, VPS hosting, managed WordPress hosting, email hosting, and domain registration services (collectively, "Services"). All Services are subject to these Terms and any additional service-specific terms communicated at point of purchase.

We reserve the right to modify, suspend, or discontinue any Service at any time with reasonable prior notice. In the event of discontinuation, we will offer a pro-rata refund for any unused paid period.

3. Accounts and Registration

To use our Services, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorised use of your account at [email protected]. You must be at least 18 years of age to use our Services.

4. Payments and Billing

All prices are displayed in British Pounds Sterling (GBP) and are exclusive of any applicable taxes. Payment is processed securely via Stripe. By providing your payment details, you authorise us to charge the amount shown at checkout.

All purchases are one-time payments for the stated service period. Services are not automatically renewed. You are responsible for renewing your service before expiry to avoid interruption. We will endeavour to send renewal reminders by email.

In the event of a failed payment, your service may be suspended until payment is received. We accept major debit and credit cards via Stripe's secure payment platform.

5. Refund Policy

We offer a 30-day money-back guarantee on all hosting plans (Web Hosting, VPS, WordPress Hosting, and Email Hosting). If you are not satisfied with your service within 30 days of your initial purchase, contact us at [email protected] for a full refund.

Domain name registrations and transfers are non-refundable once processed, as we incur immediate costs with our registrar. Please refer to our full Refund Policy for complete details.

6. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with our Acceptable Use Policy. You must not use our Services to host, transmit, or store content that is illegal, harmful, abusive, threatening, defamatory, obscene, or otherwise objectionable.

Prohibited activities include but are not limited to: sending unsolicited bulk email (spam), hosting phishing websites, distributing malware, conducting denial-of-service attacks, infringing intellectual property rights, or engaging in any activity that may damage our infrastructure or reputation.

Violation of our Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

7. Service Availability and Uptime

We target 99.9% uptime for all hosting services. Scheduled maintenance will be communicated in advance via our Status Page and by email where possible. We are not liable for downtime caused by factors beyond our reasonable control, including but not limited to natural disasters, internet infrastructure failures, or acts of third parties.

8. Data and Backups

While we take regular backups of our systems, you are solely responsible for maintaining your own backups of all data. We strongly recommend you maintain independent backups of all important data. We shall not be liable for any data loss resulting from hardware failure, software errors, or any other cause.

9. Intellectual Property

All content on nexlara.com, including text, graphics, logos, and software, is the property of Nexlara LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

You retain full ownership of all content you upload or create using our Services. By using our Services, you grant us a limited licence to host and transmit your content solely for the purpose of providing the Services.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Nexlara LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of our Services.

Our total liability to you for any direct damages shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Termination

You may cancel your services at any time by contacting us at [email protected]. We reserve the right to terminate or suspend your account at any time for violation of these Terms or our Acceptable Use Policy.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Wyoming.
